§ 5-2.1. Conformity of structures: new, substantially renovated and moved-in.

  • (a)

    Special construction considerations. Due to the unique nature of the buildings and properties located throughout the corporate limits of the Town of St. Francisville and in order that future construction is made to be architecturally and/or aesthetically harmonious with existing properties, no building permit shall be issued to any property owner or contractor for new construction, substantially renovated construction or moved-in structures and construction thereon without first being approved by the mayor and board of aldermen and then being signed by the building official.

    (b)

    Building permits required. Property owners and/or contractors shall apply for building permits by completing the necessary application forms and submitting complete building plans as required by the building code. Should the building official determine the plans are incomplete, the building official shall return said plans to the property owner and/or contractor for completion. Once the building plans are completed and returned to the building official, said official shall review the plans and inspect the properties adjoining the applicant parcel so as to determine if the proposed construction once completed will be in conformity with the adjoining construction.

    (c)

    Approval required. Only when the building official has determined that the building plans are in conformance with the building code requirements and the proposed construction will be in conformity to the adjacent properties shall the building official forward the building permit application to the mayor and board of aldermen for review and action. The approval of the mayor and board of aldermen shall herein be mandated before the building official can issue any such permit for construction.

    (d)

    Conformity with adjacent building and properties. All new construction, substantially renovated construction and moved-in structures and construction thereon shall be made to conform with adjacent buildings and properties. It shall be the intent of this subsection that the sizes of future structures shall be comparable with adjacent construction, that the use of exterior materials and colors is harmonious with adjacent construction, and that the architectural styles of future construction shall be harmonious with existing adjacent construction.

    (e)

    Moved-in buildings. A building permit shall be required to be issued prior to any structure being moved into the corporate limits of the Town of St. Francisville. No building permit shall be issued to any property owner and/or contractor desiring to move into the town any hazardous, condemned or otherwise dilapidated structure(s). No building permit shall be issued to any property owner and/or contractor to move into the town any structure where the cost to remodel, renovate, restore or modernize such structure exceeds fifty (50) percent of its value prior to the commencement of the construction of such improvements.

    (f)

    Exterior completion. The exterior of all new construction, substantially renovated construction and moved-in structures and construction thereon shall be completed within twelve (12) months after the issuance of the building permit. There shall be no extensions granted to allow for additional time to complete the exterior of any such construction. Exterior completion shall consist of all exterior surfaces being installed, including but not limited to roofing, windows, doors, siding, brick veneer or other exterior wall materials, painting and removal of construction debris.
