§ 5-2. Building permits; occupancy permits; water mains, fire hydrants.

  • (a)

    Applicability: The provisions of this section shall apply to all new construction and development of land, including but not limited to subdivision of land.

    (b)

    Building permits: No building permit shall be issued and no construction beyond site preparation shall be commenced until the owner of the property shall submit a preliminary layout or plat showing the locations of proposed buildings, streets, sewer lines, water mains, and fire hydrants. All water mains and fire hydrants shall conform to the requirements set forth hereinbelow in subparagraphs (1) and (2) of subsection (d).

    (c)

    Occupancy permits: No occupancy permit (also called certificate of occupancy) shall be issued, and no structure shall be occupied, unless the requirements of subparagraphs (1) and (2) of subsection (d) hereinbelow have been satisfied.

    (d)

    Water mains and fire hydrants: All installation work for water mains and fire hydrants shall be pursuant to the municipality's specifications and subject to inspection by the municipality prior to acceptance. All water mains and fire hydrants shall be installed prior to the start of construction so as to provide fire protection during the construction period.

    (1)

    Water mains: All water mains and extensions or construction thereof shall be in compliance with the provisions of section 12-25.

    (2)

    Fire hydrants: All fire hydrants, the size, quality, kind, number, and location thereof, shall be in at least minimum compliance with the provisions of chapter 10; provided, however, that no single-family or two-family dwelling shall be more than five hundred (500) feet from a fire hydrant as measured along the street frontage and that no multiple-family dwelling consisting of three (3) or more family dwelling units or no commercial building shall be more than three hundred (300) feet from a hydrant, as measured along the street frontage.
