§ 4-8. Livestock and poultry within the city.
(a)
Definitions. The following definitions shall apply in the interpretation and enforcement of this section:
(1)
Livestock shall include swine, hogs, of pigs, horses, cattle, mules, sheep and goats.
(2)
Person shall include all legal entities as well as natural persons.
(3)
Poultry shall include chickens, ducks, turkeys, geese, guinea fowl, peafowl, quail, pheasant and pigeons.
(b)
Prohibited generally. Except as hereinbelow permitted, it shall be unlawful for any person to raise, produce or keep on private or public premises any livestock or poultry within the corporate limits of the town.
(c)
Established subdivisions. No livestock or poultry may be raised, produced or kept within an established subdivision within the corporate limits. Outside of established subdivisions, livestock or poultry may be raised, produced or kept only in compliance with the following conditions:
(1)
Any shed, shelter or building constructed for the care of livestock shall be a minimum of fifty (50) feet from the property line and for the care of poultry shall be ten (10) feet from the property line.
(2)
All livestock shall be maintained within a fenced enclosure.
(3)
Persons wishing to raise, produce or keep livestock or poultry as permitted hereinabove shall not create a health hazard, unsanitary conditions or public nuisance, and they shall not violate any zoning or subdivision restriction where the livestock or poultry is located.
(d)
Violations. The term "person" as used herein, includes all legal entities as well as natural persons, and when premises are owned or the offense is committed by a legal entity other than a natural person, each person in control of the premises is responsible for compliance with this section and may be fined or imprisoned as provided herein. Any person or legal entity who violates the provisions of this section shall be required to conform to the standards set forth herein or to remove the livestock or poultry hereinabove described from the premises within five (5) days from the date of conviction. Failure to comply with this condition shall result in punishment in accordance with section 1-8 of this Code for each day that a person or legal entity found guilty of a violation of this section remains in violation after the five (5) days permitted for conformation to the standards set forth herein or removal of livestock or poultry as may be required by the court.
(e)
Zoning and subdivision ordinances to control. Should any of the provisions of this section conflict with any of the provisions of the municipal zoning ordinance or with any of the provisions of the municipal subdivision ordinance, then the latter ordinances (zoning and subdivision) shall prevail. No subdivision covenants or restrictions filed of record in the office of the Clerk of Court of West Feliciana Parish before or subsequent to the effective date in this section shall be construed as amending this section in any way.
