§ 8-108. Engine compression brakes.

  • (a)

    Definition: An engine compression brake, commonly called "jake brake," is a device which utilizes the power of an engine to produce a power absorbing and retarding effect to assist the slowing or braking of a vehicle, increasing engine noise and sound through the exhaust system while in use.

    (b)

    Prohibition: It shall be unlawful to operate or use within the corporate limits of the Town of St. Francisville, State of Louisiana, any freight carrying vehicle, motor carrier, semi-trailer, tandem truck, or truck-tractor (as defined in R.S. Tit. 32:1), or vehicle of any kind equipped with an engine compression brake unless said engine compression brake is equipped with a muffler in good working condition to prevent the creation of increased engine noise as a result of its use.

    (c)

    Exception: The provisions of this section shall not apply to emergency vehicles or equipment while used in actual emergencies or in training for emergencies.

    (d)

    Penalty: Any person who violates this section shall be fined not more than five hundred dollars ($500.00), or imprisoned for not more than thirty (30) days, or both.
