§ 2-22. Special and emergency meetings.

  • (a)

    The mayor or any member of the board of aldermen may call a special meeting of the mayor and board of aldermen by verbal or written notice to the municipal clerk.

    (b)

    Upon receipt of notice of a special meeting as set forth hereinabove, the municipal clerk shall prepare a notice of call specifying the date, time, and place of the special meeting and stating the agenda to be considered at the meeting. The municipal clerk and requesting official shall sign the notice of call.

    (c)

    The municipal clerk shall deliver to the chief of police the original of the notice of call plus sufficient service copies of the same. The chief of police shall serve the notice of call on the mayor, members of the board of aldermen, the municipal attorney, and the official journal. No service is necessary on the person calling the meeting.

    (d)

    Service of the notice of call shall be made as specified hereinabove no later than twenty-four (24) hours prior to the time of the special meeting.

    (e)

    Each official served with the notice of call shall sign a return and certify the time and date of service. The refusal of any official to comply with this provision shall constitute malfeasance in office and shall not bar the special meeting. Service need not be personal; it may be done at the usual residence of the official or the usual place of business of the official, and any adult person present may sign on behalf of the official to be served.

    (f)

    Upon approval of two-thirds of the aldermen present at a special meeting the board may take up a matter not on the agenda by amending the agenda.

    (g)

    The mayor and board of aldermen may hold emergency meetings in cases of extraordinary emergency, and notice of call as set forth hereinabove shall not be required; however, the mayor and board of aldermen shall give such notice of the meeting as either deems appropriate and circumstances permit.

    (h)

    Except as otherwise provided hereinabove, special meetings and emergency meetings shall be governed by the provisions of sections 2-23 and 2-24.

    (i)

    Notice of special and emergency meetings shall be posted on the door of the town hall. A copy of the notice of call of a special meeting shall be posted on the door of the town hall at least twenty-four (24) hours prior to the meeting. Notice of an emergency meeting shall state simply that an emergency meeting of the mayor and board of aldermen is about to convene or is in progress, and this notice shall be placed on the door of the town hall prior to the beginning of the meeting.
