§ 18-26. Handicapped parking.

  • (a)

    It is unlawful for the owner or operator of any unauthorized vehicle to park the vehicle or allow the vehicle to remain parked in any place on public or private property specifically designated and conspicuously marked as reserved for handicapped parking. Said designation and marking shall be done by the municipality, other federal, state or local governmental body or by the owner, lessee, trustee, manager, or proprietor of the property. The only vehicles authorized to occupy handicapped parking places are those vehicles bearing a handicapped license plate or other authorized handicapped insignia issued by the Louisiana Department of Public Safety.

    (b)

    It is unlawful for the owner or operator of any vehicle to park the vehicle or allow the vehicle to remain parked in any place on public or private property specifically designated and conspicuously marked as reserved for handicapped parking as specified in the paragraph immediately preceding hereinabove under any one or more of the following circumstances:

    (1)

    Using a forged or unauthorized handicapped license plate or other handicapped insignia.

    (2)

    Using a handicapped license plate or other handicapped insignia designated for use with a vehicle other than the parked vehicle.

    (3)

    Using a handicapped license plate or other handicapped insignia belonging to or designated for the use of anyone who is not the driver or a passenger in the parked vehicle.

    (4)

    Parking a properly authorized vehicle in a designated handicapped parking place when the person for whose benefit the handicapped parking authorization was issued is not an occupant of the vehicle or does not exit and/or enter the vehicle.

    (c)

    Penalties:

    (1)

    Any vehicle parked in violation of this ordinance may be towed away and stored by the municipality or any authorized law enforcement agency, all at the expense of the owner and/or driver of said vehicle.

    (2)

    Any person found in violation of this ordinance shall be fined no more than fifty dollars ($50.00).
